Terms of Use & Visitor Terms

These Terms of Use and Visitor Terms (“Terms”) govern your use of the Sissons’ Pumpkin Patch website and, where applicable, reservations, purchases, bookings, and other transactions made through or in connection with the website.

Please read these Terms carefully. By accessing or using the website, submitting a reservation or booking request, or completing a transaction through the website, you agree to these Terms.

References to “Sissons’ Pumpkin Patch,” “Sissons’,” “we,” “us,” and “our” refer to Sissons’ Pumpkin Patch. References to “you” and “your” include website users, purchasers, organizers, and other individuals using the Site.

1. Website Use

The Site is provided for general informational purposes and to help visitors learn about Sissons’ Pumpkin Patch, its attractions, admission, hours, events, reservations, and related services.

You may use the Site only for lawful purposes.

You may not:

  • Attempt to gain unauthorized access to the Site or its systems
  • Interfere with the operation or security of the Site
  • Introduce malicious code, viruses, or harmful technologies
  • Scrape, harvest, or systematically extract Site content without authorization
  • Use the Site to commit fraud or impersonate another person
  • Submit false, misleading, fraudulent, or unlawful information
  • Use Site content in a manner that infringes our rights or the rights of others

We reserve the right to restrict or terminate access to the Site for misuse.

2. Information, Hours, Attractions, and Availability

We make reasonable efforts to provide accurate and current information. However, dates, hours, admission prices, attractions, activities, availability, policies, schedules, and other information may change.

Operations at an outdoor seasonal attraction are subject to weather, ground conditions, staffing, maintenance, safety concerns, availability, agricultural conditions, and other circumstances.

We reserve the right to modify operating hours, close all or part of the property, suspend or discontinue an attraction, change pricing, limit capacity, or make other operational changes when reasonably necessary.

Information posted on the Site does not constitute a guarantee that any particular attraction, activity, product, service, or amenity will be available during a particular visit.

3. Weather and Closures

Sissons’ Pumpkin Patch is primarily an outdoor attraction.

Rain and other weather conditions may result in wet, slippery, uneven, or muddy conditions. We may delay opening, close early, suspend particular attractions, or close the property when we determine that weather, ground conditions, or other circumstances make doing so appropriate.

Visitors are responsible for reviewing current weather conditions and dressing appropriately, including wearing appropriate footwear.

Announcements concerning closures or operational changes may be posted on our website or social media, but visitors are encouraged to confirm conditions before traveling when inclement weather is possible.

4. Admission

Admission requirements and prices are those posted by Sissons’ Pumpkin Patch for the applicable operating date, unless otherwise agreed in writing.

Certain attractions, food, merchandise, concessions, or activities may require an additional fee beyond general admission.

Admission grants a limited right to enter the property during the applicable operating period and is subject to these Terms, posted rules, staff instructions, and other policies communicated at the property.

We reserve the right to refuse admission or require a visitor to leave the property when reasonably necessary for safety, security, violation of rules, disruptive conduct, unlawful conduct, or protection of our guests, employees, animals, property, or operations, subject to applicable law.

5. Children and Adult Supervision

Children must remain under appropriate adult supervision at all times.

Parents, guardians, teachers, chaperones, group leaders, and other supervising adults are responsible for determining whether an activity is appropriate for the children under their supervision and for ensuring that children comply with instructions, restrictions, and safety rules.

The presence of Sissons’ Pumpkin Patch employees or personnel does not replace the responsibility of a parent, guardian, teacher, chaperone, or other responsible adult to supervise children in their care.

6. Outdoor and Agricultural Environment

Sissons’ Pumpkin Patch operates in an outdoor farm environment.

Visitors should expect conditions commonly associated with outdoor and agricultural property, which may include:

  • Uneven terrain
  • Grass, dirt, gravel, mud, roots, rocks, and natural ground conditions
  • Changes in elevation
  • Wet or slippery surfaces
  • Agricultural plants, crops, straw, hay, corn, and related materials
  • Dust, pollen, insects, and other naturally occurring conditions
  • Weather exposure
  • Farm equipment and agricultural operations
  • Fire and heat in designated fire-site areas
  • Animals or animal-related activities where present
  • Other conditions inherent in an active farm and outdoor recreational setting

Visitors should remain alert to their surroundings and follow posted signs and staff instructions.

7. Attractions and Assumption of Risk

Participation in recreational, agricultural, and outdoor activities involves risks.

Depending upon the activity, these risks may include slips, trips, falls, collisions, loss of balance, contact with other participants or objects, uneven or changing surfaces, weather exposure, physical exertion, and other risks associated with activities such as slides, mazes, obstacle courses, pedal karts, straw structures, wagon rides, slingshots, pumpkin-smashing activities, fire sites, and similar attractions.

By voluntarily choosing to participate in an activity, you acknowledge that such activities involve risks and agree to exercise reasonable care for your own safety and the safety of individuals under your supervision.

You agree to:

  • Follow posted warnings and instructions
  • Follow directions provided by Sissons’ Pumpkin Patch personnel
  • Use attractions only for their intended purpose
  • Observe applicable age, size, capacity, or safety restrictions
  • Refrain from reckless, disruptive, or dangerous conduct
  • Refrain from participating when a physical condition, impairment, intoxication, or other circumstance makes participation unsafe
  • Immediately discontinue participation if instructed by staff

Nothing in these Terms is intended to waive or limit any right or liability that cannot lawfully be waived or limited.

8. Personal Responsibility

Each visitor is responsible for determining whether they are physically capable of safely participating in an attraction or activity.

If you have a medical condition, mobility limitation, allergy, sensitivity, pregnancy, injury, or other circumstance that may affect your ability to participate safely, you should use appropriate judgment and consult a qualified healthcare professional when necessary.

Visitors are responsible for their own clothing, footwear, personal property, and readiness for outdoor conditions.

9. Prohibited Conduct

Visitors may not engage in conduct that is dangerous, unlawful, abusive, destructive, threatening, or materially disruptive to other guests or operations.

Alcoholic beverages are prohibited on the premises unless Sissons’ Pumpkin Patch expressly authorizes otherwise in writing for a particular event.

Outside food is generally not permitted during ordinary admission. Exceptions may apply where Sissons’ Pumpkin Patch expressly authorizes outside food as part of a specific reservation, fire-site rental, private event, or other arrangement.

Smoking, vaping, weapons, open flames, pets, and other items or activities may be restricted pursuant to posted rules or instructions from Sissons’ Pumpkin Patch.

Service animals will be accommodated as required by applicable law.

10. Reservations, Groups, and Events

Birthday parties, field trips, private events, fire-site rentals, and other group activities may require advance reservations.

Availability is not guaranteed until a reservation has been accepted and any required deposit or advance payment has been received.

Organizers are responsible for:

  • Providing accurate reservation information
  • Communicating applicable rules and instructions to attendees
  • Providing required attendee information when applicable
  • Coordinating group payment where required
  • Ensuring appropriate adult supervision
  • Leaving reserved areas in the condition required by applicable rental rules
  • Vacating reserved areas at the end of the scheduled rental period
  • Complying with any additional terms provided for the particular event

Additional event-specific terms communicated during reservation or booking are incorporated into these Terms.

11. Fire-Site Rentals

Fire-site rentals involve additional risks associated with open fire, hot surfaces, smoke, cooking equipment, and combustible materials.

Renters and guests must exercise appropriate caution around fires and must follow all instructions provided by Sissons’ Pumpkin Patch.

Children must be closely supervised around fire areas.

Only appropriate cooking supplies and equipment may be used, and renters are responsible for the proper use of equipment they bring to the property.

Sissons’ Pumpkin Patch may prohibit or discontinue fire use when weather, wind, fire conditions, governmental restrictions, safety considerations, or other circumstances make fire use inappropriate.

12. Deposits, Payments, Cancellations, and Rescheduling

Certain reservations may require a deposit, advance payment, minimum booking amount, or payment in a single transaction.

The amount and timing of required payments will be communicated in connection with the applicable reservation.

Cancellation, refund, and rescheduling rights are subject to any terms communicated at the time of booking and applicable law.

Because Sissons’ Pumpkin Patch is an outdoor seasonal operation, weather may affect scheduled visits and events. Where appropriate, we may attempt to accommodate rescheduling requests, but alternative dates and availability cannot be guaranteed.

If Sissons’ Pumpkin Patch cancels an event or reservation, any refund, credit, or rescheduling option will be handled in accordance with the terms applicable to that reservation and applicable law.

13. Prices and Payment Information

Prices are subject to change unless a price has been confirmed as part of an accepted reservation or completed transaction.

You are responsible for providing accurate payment information and for charges associated with transactions you authorize.

If payments are processed by a third-party payment processor, that provider may collect and process payment-card and transaction information under its own terms and privacy practices.

14. Personal Property

Visitors are responsible for their own personal belongings.

To the fullest extent permitted by applicable law, Sissons’ Pumpkin Patch is not responsible for lost, stolen, misplaced, or damaged personal property unless responsibility cannot legally be excluded.

15. Photos, Descriptions, and Site Content

Photographs, illustrations, descriptions, maps, and other Site content are provided for informational purposes.

Actual conditions, attractions, appearance, crops, foliage, weather, and other characteristics may differ from photographs or descriptions due to seasonal, operational, agricultural, or environmental changes.

16. Intellectual Property

Unless otherwise stated, the Site and its text, graphics, logos, photographs, designs, layout, and other content are owned by or licensed to Sissons’ Pumpkin Patch and are protected by applicable intellectual-property laws.

You may view and use the Site for your personal, noncommercial use.

You may not reproduce, distribute, modify, republish, sell, exploit, or create derivative works from protected Site content without prior permission, except as permitted by law.

17. Third-Party Services and Links

The Site may contain links to or integrations with third-party websites, mapping services, social-media platforms, payment providers, or other services.

These services are operated independently of Sissons’ Pumpkin Patch.

We do not control and are not responsible for the availability, security, content, accuracy, privacy practices, or terms of third-party services. Your use of a third-party service is governed by that provider’s terms and policies.

18. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

SISSONS’ PUMPKIN PATCH DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

Nothing in this section limits any warranty or right that cannot legally be disclaimed.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SISSONS’ PUMPKIN PATCH AND ITS OWNERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF THE SITE.

With respect to visits to the property, attractions, activities, or events, liability will be determined in accordance with applicable law, including applicable duties, defenses, statutory protections, and principles concerning assumption of risk and comparative negligence.

Nothing in these Terms is intended to disclaim liability that cannot legally be disclaimed, including liability that applicable law prohibits a party from excluding.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Sissons’ Pumpkin Patch and its owners, employees, and representatives from third-party claims, damages, losses, liabilities, and reasonable expenses arising from your unlawful use of the Site, your material violation of these Terms, or information or content you submit in violation of another person’s rights.

This provision does not require you to indemnify Sissons’ Pumpkin Patch for claims resulting solely from conduct for which indemnification cannot lawfully be required.

21. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles, except where federal law applies.

To the extent a dispute concerning these Terms may lawfully be required to be brought in a particular jurisdiction, the parties agree that state and federal courts having jurisdiction in or serving Erie County, Pennsylvania will be the appropriate venue, subject to applicable law.

22. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.

23. No Waiver

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

24. Changes to These Terms

We may update these Terms from time to time.

Changes become effective when posted unless otherwise stated. The Effective Date at the top of this page will identify the most recent revision.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms with respect to subsequent use, to the extent permitted by law.
